Terms and Conditions
Effective date: October 7, 2026
These Terms and Conditions ("Terms") govern your access to and use of the Pexpy platform, websites, apps and related services (the "Service"). The Service is provided by PX Digital Solutions LLC, a Wyoming limited liability company ("PX Digital", "we", "us" or "our"). By creating an account, starting a trial or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm that you can bind that company to these Terms.
1. Accounts
- You must give accurate information when you sign up and keep it up to date.
- You are responsible for everything done under your account, including by people you invite. Keep your login details confidential and tell us at once at [email protected] if you suspect unauthorised access.
- You must be at least 18 years old, or the age of majority where you live, to use the Service.
2. Subscriptions, trials and payment
- Paid plans are billed in advance for the billing period you choose (monthly or annual) and renew automatically until cancelled.
- Prices, plan limits and usage-based charges are shown in the app and on our pricing page. Taxes are added where the law requires.
- If a payment fails, we may limit paid features after giving you notice and a reasonable chance to update your payment method.
- Free trials end on the date shown in the app. If you do not choose a paid plan, the workspace moves to a restricted, billing-only mode; your data is kept as described in our Privacy Policy.
- Refunds and cancellations are covered by our Refund and Cancellation Policy.
3. Your data
- You keep all rights to the content and data you put into the Service ("Customer Data").
- You give us the limited permission needed to host, process, back up and display Customer Data so that we can provide and support the Service.
- We process personal data inside Customer Data as your processor, under our Privacy Policy and, where required, a data processing agreement.
- You are responsible for having a lawful basis to collect and use the personal data you store in the Service, including the contact details of your own customers.
4. Acceptable use
You must not:
- break any law, or infringe anyone's intellectual property, privacy or other rights;
- send spam or unsolicited bulk messages, or use the Service for phishing, fraud or malware;
- try to access other customers' workspaces or data, probe or bypass our security, or overload the Service;
- resell or sublicense the Service unless we have agreed to it in writing (for example, as an agency partner);
- reverse-engineer the Service except where the law expressly allows it.
We may suspend accounts that put the Service, other customers or the public at risk. Where possible we will tell you first and give you a chance to fix the problem.
5. AI features
Some features use artificial intelligence to draft text, summarise information or suggest actions. AI output can be inaccurate. Review it before you rely on it or send it to others. You stay responsible for decisions you make with it.
6. Third-party services
The Service can connect to third-party products (for example email, calendars, payment providers, advertising or marketplace accounts). Your use of those products is governed by their own terms. We are not responsible for third-party services, and integrations may change when those providers change their products.
7. Availability and changes
We work to keep the Service available and secure, but we do not promise that it will be uninterrupted or error-free. We may improve, change or retire features. If a change materially reduces the Service you pay for, we will tell you in advance.
8. Intellectual property
The Service, including its software, design and documentation, belongs to PX Digital and its licensors. These Terms do not transfer any of those rights to you, apart from the right to use the Service as described here.
9. Confidentiality
Each party will keep the other's non-public business information confidential and use it only to perform these Terms.
10. Warranties and limitation of liability
- The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
- To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
- To the extent the law allows, our total liability for any claim relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim.
- Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You will defend and indemnify PX Digital against third-party claims arising from your Customer Data or your breach of these Terms.
12. Term and termination
You can cancel at any time from the billing settings in the app or by emailing [email protected]. We may end these Terms if you materially breach them and do not fix the breach within 15 days of notice. After termination you can export your data for 30 days; after that we may delete it as described in our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The state and federal courts located in Wyoming have exclusive jurisdiction, unless mandatory consumer law where you live gives you the right to bring a claim in your local courts.
14. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new effective date and, for material changes, give you at least 30 days' notice by email or in the app. Continuing to use the Service after the effective date means you accept the updated Terms.
